A HAMILTON man has been released on bail while he appeals his prison sentence for assaulting his former partner during an argument over alcohol.
The 39-year-old man, who can’t be named without identifying the victim, was sentenced to three months behind bars in the Hamilton Magistrates Court on Wednesday after pleading guilty to recklessly causing injuring, breaching a family violence order and breaching a community corrections order.
He filed an appeal against the sentence that afternoon and successfully applied for bail on Thursday in the Warrnambool Magistrates Court.
Magistrate, Mark Stratmann said there were compelling reasons he should be released on bail, including that his appeal had been scheduled in the County Court in mid-February, by which time he would have already served around half of his sentence.
